The Challenge: To translate a 200-page legal contract from Spanish into English in less than 48 hours.

The power of language: Lawyers recommend to use the following linguistic tactics that will help you win:

  1. Use softer words and harsh arguments. For example, instead of saying, "we need to resolve these issues", you might want to say, "we need to re-structure our work process".
  2. Reframe and Rephrase accusations. If let's say a client accuses you of not doing your job properly, try to address him or her by highlighting some of the positive aspects of your argument. For example, "I expected a better quality!" and to that you might want to reply, "O.K. let's discuss how else our services could have benefited you". 
  3. Chose your words carefully. Two words that are commonly used in legal jargon are "opposing" and "opposite". It is better to say that you have an "opposite point of view" rather than an "opposing point of view". 
  4. Demonstrate Respect. It is always a good idea to be official when it comes to proving your point. Therefore, using official language, such as Mr. Smith, instead of just "he" or "Smith", will score you more points.
  5. Never Say "With all due respect". Lawyers claim that this is one of the most disrespectful phrases you could possibly say during an argument. 
  6. Never Say Never. Try to avoid generalizations because no one will believe words like "Always" and "Never".
  7. Raise Issues and Offer Suggestions. It is easy to point out mistakes but in order to solve them it is a good idea to offer some solutions to these problems. This will show that you are not simply planning to accuse someone, but would like to work together with this person to resolve problems.

What Happens When Interpreters Go Wrong?

 

    Japan Today reports that a German woman was given a prison term at the Osaka District Court for violating a Drug Control Law. Accidentally, during a review of the trial records, it has been noted that more than 60% of the trial contents and evidence were mistranslated. Subsequently, a lawyer appealed the sentence stating interpreter's lack of legal knowledge and ability to translate.

    This is just one case of mistranslations that was reported in the news. According to the Japan's Supreme Court, in 2009 about 4,000 trials were supported by interpreters and since April, 4,076 more multilingual trials are scheduled that require legal interpreters in more than 50 languages.
